リーマンショック当時のCDSなどを取り扱ったThe Big Shortという映画が日本では3月4日から劇場公開になるそうですが、面白いタイミングです。今年初めから、ドイツ銀行のCoCo Bondを保証（するみたいな）5 Year CDSのスプレッドが1.87%から4.38％に倍増したそうです。
今年から、ヨーロッパのドイツ、イタリアを震源とする金融不安が始まり、中国の不動産バブルの明確な崩壊へとバトンリレーして、リーマンショックの恐怖が再来する危険があるかもしれません。
リーマンショック後、地震が発生するまでにリーガル・マーケットも縮小して外資系企業や外資系法律事務所の弁護士のレイオフが進みました。稼ぎ頭だった不動産の証券化、流動化弁護士が抹殺されてゆき、コーポレートや他のファイナンスも縮小しました。今度も、金融危機でファイナンスを始めとする分野が被害を受ける危険があります。今後は、支出を控えて嵐に備える必要があるかもしれません。現在の株式市場のリバウンドのチャンスを捉えて全ての株式は売却し、不動産も処分して、万が一、危機が発生した時に円が上がるチャンスがあれば通貨はドルに変えるなどして、資産の状況を確認した方がいいかもしれません。今年から来年にかけて、厳しい状況が来るのに備えて。

アベノミクスは証券業界に利益をもたらしましたが、やはり問題の先延ばしにすぎないかもしれません。来年はとても厳しい状況が発生するかもしれず、下記のようなリポートもあります。さてどうなるでしょう。とりあえず、まさかの時に備えた対策を一応考えておこうかと思います。

I’d be surprised if both didn’t continue down in the 4th quarter.
This will end badly… which is the only way bubbles end.
My forecast today: the stock market will start to crash by early February, if not sooner, when it finally gets this clear realization.

AshurstがオーストラリアのBlake Dawsonとは２年前に提携関係に入り合併へと進んで参りましたが、財務面も含めて完全合併することになったそうです。
イギリスの法律事務所は伝統的にLockstepがしっかりとしており、パフォーマンスベースの報酬体系要素が比較的弱いと言われています。Clifford Chanceが米国NYのファームと合併したときも、パフォーマンスベースで高い報酬を得ていたパートナーが流出する事態が発生していました。
今回Ashurstは同一のファームとしての一体感、同僚意識を確実にする為か、あえて財務面での統合で問題があったとしても完全合併の選択肢をとった模様です。報酬に関連して、グローバルなネットワークを作ると地域によりパフォーマンスが為替の変動により分かりにくかったりする問題が発生しますが、避けては通れないものとして対応を事前に考えておくしかないようです。

フランスでさえも労働法関連規制の合理的な変更を模索する方向で動いているようです。ある時代の経済情勢を前提として「固定」するような規制は必ず破綻するので、成熟経済を迎えた先進国ではセーフティーネットのデザインを、社会が変化してもなるべく個人を支えるスタイルに変える必要が不可避です。

この点、民主党政権は真逆の規制を施してきましたが、本当に問題の多い結果的に無駄な政権交代だったと現時点では言えるようです。セーフティーネットのデザインの根本的な改革がどうしても避けて通れない状況と言えます。

一票の格差の訴訟は選挙ごとに提起されており、これからも日比谷パークの先生やその他の弁護士方のライフワークのようなかたちで続くのだと思われます。ただ、最近ようやく旧来のメディアでも取り上げられるようになった世代間格差是正のアイディアとして提案されることのある、世代別国会議員選出制度創設の為に選挙制度を変えることは、一票の格差と正面から衝突します。そこで、そのような制度を許容するための理論的説明のアイディアが必要になってきます。アファーマティブアクションみたいな説明などで裁判官を納得させることができるような理論構成が必要となります。無理と決めつけないでアイディアや知恵次第ですね。どうしたらできるのかな、という視点はどんなときでも大切と感じます。
